What Is Legal Heir Certificate?

A legal heir certificate certifies a person's relationship to a deceased. Typically, it is used to claim the provident fund, gratuity benefits and properties of a person who is no more. It generally includes the applicant's name, residence, relationship to the deceased, name of the deceased and date of their death. It ensures a smooth transfer of rights and responsibilities from the deceased to their legal heirs. In India, a legal heir certificate will be needed when the deceased has not selected any nominee.

Process Of Acquiring Legal Heir Certificate

  Application Form

  To apply, the applicant has to visit the nearest village administration office or the online portal. They will be given an application form. They have to fill and submit it with the necessary documents

  Document Gathering

  The applicant has to gather all the required documents. Some important documents are death certificate, identity proof, documents supporting the applicant’s relationship to the deceased, etc.

  Prepare Affidavits

  The applicant has to submit a notarised affidavit to confirm their relationship to the deceased. They should also submit some evidence to support their affidavit.

  Application Submission

  The applicant has to send the completed application form, the affidavit, and other documents to the tahsildar of their locality. They have to ensure that all the necessary documents are attached.

  Will Be Given A Token

  After collecting the application, affidavit and other documents, the applicant will be given a token. Your submissions will be reviewed on a designated day, ensuring a systematic and organised process.

  The tahsildar will examine the application. He or she will carry out a local inspection of the applicant and the deceased to ensure the authenticity of the claim.

Documents Required

• Copy of ID proof such as PAN, Aadhaar, etc., of all the legal successors.
• Original death certificate of the deceased.
• Relationship proof (birth certificates, marriage certificates, Ration cards, etc.)
• Legal heirship affidavit.
• Passport-size photographs.
• Residence proof.
• The applicant, who is seeking the certificate on behalf of all the legal heirs, must self-attest the copies of ID proof and address proof that are submitted.
